RULES AND REGULATIONS

NO PURCHASE NECESSARY TO ENTER THE CONTEST. CONTEST IS VOID IN WHOLE OR PART WHERE PROHIBITED BY LAW. SEE ELIGIBILITY SECTION BELOW FOR FURTHER DETAILS. TO COMPLETE YOUR ENTRY YOU MUST READ AND AGREE TO THE FOLLOWING TERMS. PARTICIPATION IN THIS CONTEST CONSTITUTES FULL AND UNCONDITIONAL AGREEMENT AND ACCEPTANCE OF THESE CONTEST RULES. ALL DOLLAR AMOUNTS ARE IN CANADIAN FUNDS ($CDN) UNLESS OTHERWISE NOTED. YOU MUST BE OVER THE AGE OF (18+) TO ENTER. ENTRIES ARE ONLY OPEN TO RESIDENTS OF BRITISH COLUMBIA IN CANADA MUST BE ABLE TO TRAVEL TO THE CENTRE TO REDEEM THE PRIZE. PRIZE MUST BE CLAIMED AT THE BAY CENTRE IN PERSON.

(1) SPONSOR

The Contest is sponsored by THE BAY CENTRE (TBC NOMINEE INC.; Manulife Financial Corporation and all subsidiaries as now exist or may later be constituted including but not limited to The Manufacturers Life Insurance Company and Manulife Investment Management Private Markets (Canada) Corp.; and Jones Lang Lasalle Real Estate Services Inc. hereinafter collectively called THE BAY CENTRE) 2-1150 Douglas Street, Victoria, B.C., V8W 3M9.

(2) CONTEST PARTIES

Contest Parties include “Sponsor” subsidiaries, affiliates, nominees, parent companies and advertising/promotional agencies. They include but are not limited to THE BAY CENTRE.

(3) CONTEST PERIOD (the “Contest Period”):

The contest begins Monday, August 14, 2023 at 10:00 am (PT) and ends Sunday, September 17, 2023 at 11:59 pm (PT) (the “Contest Closing Date”).

(4) HOW TO ENTER

No purchase necessary.
Log onto Facebook, Instagram and/or TikTok and visit the Sponsor’s Facebook Page (www.facebook.com/thebaycentre) or Instagram Account (www.instagram.com/thebaycentre) or TikTok Account (www.tiktok.com/@thebaycentre) and follow the instructions per the giveaway post or follow the instructions per the Facebook, Instagram or TikTok ads if you are targeted with it in your Facebook News Feed, Instagram Feed or TikTok Feed.

Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook/Instagram/TikTok. THE BAY CENTRE reserves the right to change or cancel this giveaway at anytime.

All submitted entries information exclusively becomes the property of the Sponsor and Contest Parties. The Sponsor and Contest Parties shall have the perpetual, irrevocable, world-wide and fully-transferable right (but not obligation) to use, modify, display, reproduce, make derivative works of for promotional purposes in any manner or media whether now or hereafter existing and/or to otherwise use or commercially exploit any entry (or any part thereof) or information or ideas contained within any entry, all without further payment, consideration, attribution, notice or consent. Entries generated by a computer program, robotic or other automated means will be disqualified.

Sponsor will not be liable for entries that are incomplete, illegible, corrupted, false, lost or late or otherwise not in compliance with these Rules of the Contest. These entries may be disqualified from the Contest at the Sponsor’s sole discretion.

(5) THE PRIZE:

There will be two (2) Winners, each selected at random from the entries collected through the entry forms featured in each of the different giveaways and depending on which giveaway the winner has entered to win, they could win one of the following “Prize”:

Bag 1 Prize: One (1) Six Hundred Dollar ($600) Bay Centre gift card. Winner from entries received August 14, 2023 to August 30, 2023.
Bag 2 Prize: One (1) Six Hundred Dollar ($600) Bay Centre gift card. Winner from entries received August 31, 2023 to September 17, 2023.

Which prize was won will be provided to the winner when contacted. The Approximate Retail Value (“ARV”) of the Grand Prize is Six Hundred dollars ($600) based on Manufacturer’s Suggested Retail Price. If the actual value is less than the stated ARV in these Official Sweepstakes Rules, the difference will not be awarded in cash.

The following conditions apply:

All prizes must be claimed and/or contest release forms signed by Saturday, October 17, 2023 at 5:00 pm (PT).

The prizes are non-negotiable, non-transferable and non-refundable nor redeemable for cash.
Prizes must be accepted as awarded and have no cash equivalent. Substitutions of equal value may be made at discretion of contest organizers. Winner must answer a skill testing question. Use of Bay Centre gift card is subject to their terms and conditions, which are available at Bay Centre’s Guest Services desk, located on the lower level.

If for any reason, the winner is unable to accept the prize as awarded, the winner forfeits his/her right to the prize without compensation.

All entrants confirm their compliance with these official contest rules by submitting their entry.

(6) WINNER SELECTION AND ODDS

There will be two winner selection draws. Bag 1 Prize will be drawn on Thursday, August 31, 2023, one eligible entrant(s) (“Potential Winner”) will be selected by random draw from among all eligible Entries submitted and received in accordance with these Rules. Bag 2 Prize will be drawn on Monday, September 18, 2023, one eligible entrant(s) (“Potential Winner”) will be selected by random draw from among all eligible Entries submitted and received in accordance with these Rules.

The odds of winning depend on the number of eligible Entries received.

(7) PRIZE WINNER CONFIRMATION PROCESS

Sponsor will make a minimum of 2 attempts to contact the Potential Winners by Wednesday, September 24, 2023 using the information provided on the corresponding Entry. In the event Sponsor is unable to contact the Potential Winner, or if there is a return of any notification as undeliverable, such Potential Winner may be disqualified at Sponsor’s sole discretion, and Sponsor may, at its sole discretion, hold another random draw to select another eligible entrant from among the remaining eligible Entries, in which event the provisions of this section will apply to such newly selected entrant.

Before being declared a confirmed Prize winner, the Potential Winner must sign Sponsor’s release and acknowledgment form to receive the Prize, which, among other things, (i) confirms compliance with these Rules, (ii) acknowledges acceptance of the Prize as awarded, (iii) releases (a) Sponsor and its affiliates and subsidiaries, (b) the prize suppliers, advertising/promotion agencies, and all other entities and persons involved in the development, production, implementation, administration, judging, and/or fulfillment of the Contest, and (c) each of the respective officers, directors, employees, agents, representatives, successors, and assigns of the persons identified in items (a) and (b) (collectively, the “Released Parties”) from any liability in connection with the Contest and the Prize, and (iv) confirms agreement to the publication, reproduction, and/or other use of his or her name, address, voice, statements about the Contest, and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of Sponsor in any manner, including, but not limited to, print, broadcast, and/or the Internet (including, but not limited to, social media).

If a Potential Winner: (a) fails to return the properly executed Contest documents as outlined herein within a time sufficient to allow for the proper administration of the Contest and awarding of the Prize, (b) cannot accept, or is unwilling to accept, the Prize as awarded for any reason, and/or (c) is determined to be in violation of these Rules, all as determined by Sponsor in its sole discretion, he or she may, in Sponsor’s sole discretion, be disqualified (and if disqualified, will forfeit all rights to the Prize), and Sponsor reserves the right, in its sole discretion and time permitting, to select an alternate Potential Winner in accordance with the procedures outlined in these Rules, in which case the foregoing provisions of this section will apply to such newly selected Potential Winner.

By entering the contest, you agree to be bound by the Contest Rules and the decisions of THE BAY CENTRE, which decisions are final with respect to all matters relating the contest.

(8) ELIGIBILTY:
Employees and their immediate families of THE BAY CENTRE or its affiliates, Bay Centre tenants and their employees, advertising agency and consultants, and other sponsors, and suppliers and their employees are not eligible to enter and the immediate families (spouse, parents, siblings, and children) of each of the above.

YOU MUST BE OVER THE AGE OF (18+) TO ENTER. ENTRIES ARE ONLY OPEN TO RESIDENTS OF BRITISH COLUMBIA IN CANADA AND MUST BE ABLE TO TRAVEL TO THE CENTRE TO REDEEM THE PRIZE. PRIZE MUST BE CLAIMED AT THE BAY CENTRE IN PERSON.

(9) GENERAL RULES:
The contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. All incidental costs and expenses not specifically referred to herein, including (without limitation) taxes shall be the sole responsibility of the prize winner.
By entering the Contest, entrants agree to hold harmless THE BAY CENTRE and its affiliates, subsidiaries, agents, directors, officers and employees, THE BAY CENTRE (collectively the “Released Parties”) against any and all liability, damages or causes of action (however named or described) with respect to or arising out of: (i) entrant’s participation in the contest, (ii) the receipt or use of the prize awarded therein, or (iii) the administration of the Contest and the distribution of the prize awarded therein.

Prize must be claimed in person and winners are responsible for their own transportation to and from THE BAY CENTRE. Before being awarded a prize, THE BAY CENTRE winner selection panel must verify the winner ensuring their photo identification matches the information provided during the online registration process. Upon approval, the selected entrants must sign a BAY CENTRE standard form of Declaration, Release and Waiver, releasing the Released Parties from any liability arising from, among other things: (i) participation in the Contest, (ii) acceptance of the prize awarded therein, or (iii) the administration of the Contest and the distribution of the prize awarded therein.

Prizes must be accepted as awarded and cannot be exchanged for cash or otherwise. No telephone contact or correspondence will be conducted except with a selected entrant. THE BAY CENTRE reserves the right to substitute prizes of equal or greater value and/or terminate, modify or withdraw this contest, in whole or in part, at any time, without prior notice for any reason including but not limited to, viruses, bugs, tampering or other causes beyond THE BAY CENTRE control which affect the administration, security, fairness or proper play of the contest. In the event a substitute prize is awarded such prize must be accepted as awarded and cannot be exchanged for cash or otherwise.

Subject to the right of THE BAY CENTRE to make all determinations relating to the contest, any controversy or dispute arising out of the conduct of this Contest shall be resolved in the courts of the province of British Columbia applying the law of British Columbia and Canada, as the case may require which exclusive jurisdiction and law entrants agree to submit as evidenced by their participation in the Contest.

All entries must be acquired in an ethical fair manner (Unethical may refer but is not limited to: bots, spamming, fake or multiple email accounts). Any attempt to subvert the process will lead to automatic disqualification.

(10) USE OF CONTEST INFORMATION:
By submitting the contest entry, all entrants consent and acknowledge that THE BAY CENTRE shall have the right to use any, and all information relating to Contest, including information on entrants obtained through the Contest, for purposes of running the Contest and, where expressly consented to, for marketing purposes, unless prohibited by law. Entrants’ information shall not be provided to any third party unless the entrant grants its consent to THE BAY CENTRE. (11) LIMITATIONS OF LIABILITY:
The Released Parties are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programing associated with or utilized in the Contest or by any technical or human error which may occur in the processing of submissions
in the Contest. The Released Parties assume no responsibility for any error, omission, tampering, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of entries. The Released Parties are not responsible for any problems, viruses or technical malfunction of any telephone network or lines, computer on-line systems, server providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the internet or at any website or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in the contest.
